VAT for UAE contractors: advances, progress invoices and retention

Last updated

Construction services in the UAE are generally standard-rated at 5%. Because contracts are paid in stages, the FTA applies the continuous-supply rule: VAT is due at the earliest of a tax invoice, the payment due date on it, or receipt of payment, with a 12-month backstop. Advances are taxed when invoiced, and VAT on retention is due at the earliest of its payment, an invoice for it, or 12 months after sign-off.

The rate

The standard VAT rate in the UAE is 5% under Federal Decree-Law No. 8 of 2017. Most construction services are standard-rated. Specific exceptions exist, such as the first supply of certain residential buildings, which the FTA's real estate guide explains. Use the VAT calculator to add or remove 5%.

When VAT is due on a construction contract

Article 26 of the VAT Decree-Law covers supplies with periodic payments or consecutive invoices. The FTA says a contract with an advance, stage payments or retention falls under it. The date of supply is the earliest of the invoice, the payment due date on it, or receipt of payment. If none of those happens, VAT is triggered 12 months after the work was provided.

In practice the consultant's payment certificate sets the payment due date, and the interim payment application behind it is what the certificate approves, so the paperwork and the VAT date are linked even though the certificate itself is not the trigger. The retention calculator shows how retention builds before its VAT falls due.

Advances

An advance payment is taxed when it is invoiced or received. As it is recovered from each certificate, the recovery reduces the taxable value of that invoice, so the same money is not taxed twice. The advance recovery calculator shows the schedule and the VAT reversed each time.

Retention

There are no special date-of-supply rules for retention; the continuous-supply rules apply. Contractors handle it one of two ways: charge VAT on the full certified value on each progress invoice and hold retention back from payment, or leave retention out of the progress invoice and charge its VAT on the release invoice, within the 12-month limit. SupaJack Construct supports both and locks the choice once the first progress invoice posts, so returns stay consistent. Compare them in the payment certificate calculator.

Keeping the VAT return and the ledger in step

The most common error is a VAT return built from invoices that do not match the ledger. In SupaJack Construct each progress invoice posts to the ledger in the same step, using the same VAT rule, so the return and the accounts agree. Read the interim payments guide and see the money trail.

Changes to watch

The Ministry of Finance announced amendments to the VAT law taking effect from January 2026. Check the FTA's current legislation page and your tax adviser for anything that changes how your contracts are treated.
