Can a UAE worker quit without notice?

Last updated

Yes, in four cases set by Article 45 of Federal Decree-Law No. 33 of 2021, and the worker keeps all end-of-service rights: an unremedied breach reported to MOHRE 14 working days before, assault or harassment reported within five working days, a grave danger the employer ignores, or work fundamentally different from the contract without written consent.

The conditions in detail

Breach: the worker tells the Ministry 14 working days before leaving and the employer fails to put it right after the Ministry notifies it. Assault, violence or harassment by the employer or its legal representative: the worker informs the authorities and the Ministry within five working days of being able to. Grave danger: the employer knows of it and takes no action to remove it. Different work: assigned without written consent, except in the necessity cases in Article 12.

Why this matters to contractors

Unpaid wages are the most common employer breach. A worker who reports late salary to MOHRE and is still unpaid can leave without notice and claim full gratuity. Unsafe sites carry the same risk under the grave danger case.

How SupaJack Construct helps

Payroll runs produce the WPS file on schedule and keep each payment traceable from payslip to bank file, which is the evidence an employer needs to show wages were paid.

Worked example

Two months' wages for a fit-out crew are unpaid. A carpenter reports this to MOHRE on 1 March. If the contractor has not paid after the Ministry contacts it, the carpenter can leave on or after the 14th working day with his gratuity and other entitlements intact.

Questions people ask

Must the worker tell MOHRE first?

For a breach, yes, 14 working days before leaving.

Is the employer told before the worker leaves?

The Ministry notifies the employer, which can remedy the breach.
