Is the first sale of a new residential building zero-rated in the UAE?
Yes, if it is the first supply and happens within three years of the building's completion. The FTA real estate guide says the first supply of a residential building, by sale or lease, is zero-rated, so the developer can recover VAT on its costs. Later supplies, even within those three years, are exempt.
What counts as the first supply
It is the first supply of the building or part of it, by sale or by lease. For a building completed before 1 January 2018, a first supply after that date still qualifies only if it is the first ever supply and within three years of completion.
A building converted to residential use can also be zero-rated on its first supply within three years of the conversion, under conditions in Article 39 of the Executive Regulation.
Why it matters to contractors
The developer's ability to recover the contractor's 5% depends on its sales being zero-rated rather than exempt. A developer who rents units out first and sells later may lose recovery, which can affect payment terms it negotiates with contractors.
How SupaJack Construct helps
Contractors charge 5% on their services in every case, and the system records the project's completion certificate date, which is the date the three-year window counts from.

Worked example
A building is certified complete on 1 June 2025. The developer sells apartment 1201 on 1 September 2025 as its first supply, zero-rated. The buyer resells it in 2026, and that resale is exempt even though it is within three years.
Questions people ask

Does a first lease count?
Yes. The first supply can be by sale or lease.
What if the first sale is four years after completion?
It falls outside the three-year window and is not zero-rated.
